Release and Waiver of Liability and Indemnity Agreement
(Read Carefully Before Signing)
I understand that there are inherent risks and dangers associated with participating in gym
activities and that in order to participate, in any such activities, including but not limited to
Brazilian Jiu Jitsu, Primal Conditioning, Yoga and any other martial arts classes, physical training,
including classes, training involving the use of fitness equipment and fitness and training
seminars (the Classes), I must give up my rights to hold Kingdom Martial Arts Pty Ltd and any
other entity or individual associated with Kingdom Martial Arts Pty Ltd, responsible or liable for
any damage that I may suffer while participating in the Classes, or waiting on Kingdom Martial
Arts Pty premises to participate in the Classes, and whilst walking through the premises at
Kingdom Martial Arts Pty Ltd before and after the Classes.
Knowing this and in consideration for being permitted to participate in the Classes with Kingdom
Martial Arts Pty Ltd, I hereby voluntarily forever release, discharge and hold completely harmless
Kingdom Martial Arts Pty Ltd, and all other entities or individuals associated with Kingdom
Martial Arts Pty Ltd, and their members, offices, directors, agents, employees, heirs, assigns and
independent contractors from any and all responsibility for, or liability resulting from or arising
from, my participating in the Classes, and being at or on the premises at Kingdom Martial
Arts Pty Ltd.
I understand that the Classes may include, but will not be limited to, activities such as kicking,
punching, hitting, stretching, twisting, jabbing, lunging, rolling, falling, jumping, hand locks, foot
locks and the use of various martial arts and fitness equipment. I realize that these activities,
as well as all other martial arts activities, can be dangerous, but I am voluntarily choosing to
participate in the Classes and agree to completely assume the risk associated with my
participation.
I understand that I am assuming full responsibility for any and all risks of death, personal injury,
emotional pain and suffering, property damage and economic loss that might be suffered by me
as a result of my participation in the Classes. I agree that this release shall bind me, my spouse,
my heirs, my personal representatives, my assigns, my children, my parents and their agents.
I hereby further agree to release, indemnify and hold completely harmless Kingdom Martial Arts
Pty Ltd, and all other entities and individuals associated with Kingdom Martial Arts Pty Ltd, and
their members, officers, directors, agents, employees, heirs, assigns and independent
contractors harmless from any and all liability and costs, including attorney fees, associated
with or arising from my participating in the Classes at Kingdom Martial Arts Pty Ltd, waiting at
or on Kingdom Martial Arts Pty Ltd premises to participate in the Classes, and walking through
the premises at Kingdom Martial Arts Pty Ltd before or after the Classes.
I understand that if I or anyone related to me were to institute a legal action against Kingdom
Martial Arts Pty Ltd, or any other entity or individual associated with Kingdom Martial Arts Pty
Ltd as a result of any personal injury including death, emotional pain and suffering, property
damage or economic loss suffered by me as a result of my participation in the Classes, waiting
at or on Kingdom Martial Arts Pty Ltd premises to participate in the Classes, and walking
through the premises at Kingdom Martial Arts Pty Ltd before or after the Classes, that this
release would bar the legal action and the Court would dismiss it on the grounds that by signingthis release, I have expressly assumed all the risks associated with participation in the Classes,
including but not limited to negligence on the part of the instructors in the performance of their
duties, negligence by other members of Kingdom Martial Arts Pty Ltd, negligence in the
operation of machinery or equipment, and any other premises liability.
If I am signing this release on behalf of a minor child, I understand that I am giving up the same
rights for the said minor as if I signed this release on my own behalf. I have read this
agreement and understand the words and language in it and confirm that I am advised of all
potential dangers incidental to participation in the Classes at Kingdom Martial Arts Pty Ltd,
including travel to and from their premises. I also understand that it is my responsibility to
consult my doctor and other health professionals about the wisdom, viability and inherent risks
of my or my child’s participation in the Classes
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND
INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE
GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND
VOLUNTARILY WTHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE
TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF
ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
